Texas Blockchain Council, Inc. and Riot Platforms, Inc., requested a temporary restraining orders from Federal District Judge Alan Albright today at 11:30am in Waco, Texas, blocking the Energy Information Administration (EIA) from enforcing its “emergency” survey.
At the hearing, attorneys for Government offered an EIA administrator DeCarolis’ voluntary declaration, which provided a four week pause in enforcement and collection. Judge Albright, realizing that the Government’s promise was nothing but a hollow promise without an enforcement mechanism, ordered the Government. work With the Plaintiffs, create a negotiated settlement that would fully bind Government to:
- The survey must be completed within the four week period.
- Notify anyone who is not yet in compliance that they do not need to comply immediately;
- Assure the Agency that any information it receives, whether received before or after the date of the request, will not be used.
The order is national in scope so that every miner across the US can be covered.
The Judge said that if the Government cannot reach an agreement before 3pm Central time today, he will issue a Temporary Restrictive Order, which would have the same effect, but accelerate the timeline for the permanent injunction.
The EIA is stalling in their (alleged) illegal) ways. We will know more about this in a few minutes when the final order has been entered. “emergency” data collection.
